NMC Withdraws Medical Education Standards Rules, Removes Specific Penalties for Colleges

NMC withdraws MSMER-2023, removing specific penalties for medical colleges while retaining mandatory Annual Disclosure Reports under applicable law.
The National Medical Commission (NMC) has withdrawn the Maintenance of Standards of Medical Education Regulations, 2023 (MSMER-2023), removing the specific penalty framework that previously governed violations of medical education standards by medical colleges across India.
The decision was announced through a notification dated October 14, 2026, published in the Gazette of India. The withdrawal took effect immediately, according to reports published by India Today and The Times of India.

What Has Changed Under the NMC Decision?
The withdrawn regulations outlined the actions that could be taken against medical colleges that failed to meet prescribed standards, provided inaccurate information about their facilities or committed other regulatory violations.
Under the earlier framework, colleges could face financial penalties of up to ₹1 crore for each violation. Other measures included restrictions on admissions, reductions in approved seats, restrictions on applications for new courses and withdrawal of accreditation for up to five academic years.
The regulations also prescribed penalties of up to ₹5 lakh for faculty members and administrators found submitting false declarations or records.

With the withdrawal of MSMER-2023, these specific penalties and the associated enforcement framework no longer apply as provided under the withdrawn regulations. The change does not, however, mean that medical colleges are exempt from all regulatory obligations.
Annual Disclosure Reports Remain Mandatory
One important requirement continues despite the withdrawal. Medical colleges must still submit Annual Disclosure Reports (ADRs), which provide information about faculty members, infrastructure and institutional facilities.
The NMC has clarified that this obligation continues under the National Medical Commission Act, 2019, and the applicable legal framework. The withdrawal of the 2023 regulations does not eliminate the statutory requirement to furnish these reports.

Colleges must therefore continue to meet the applicable disclosure and reporting requirements.
What Happens to Existing Approvals and Pending Cases?
The notification includes provisions addressing the transition from the old regulations to the applicable legal framework.
Actions taken, approvals granted, renewals issued and decisions made under the 2023 regulations before their withdrawal are not automatically invalidated. The notification also addresses existing rights, obligations and liabilities, as well as proceedings pending at the time of withdrawal.
Cases arising after the withdrawal will be governed by the NMC Act and the statutory and regulatory provisions applicable at the relevant time.
What Does This Mean for Medical Colleges and Students?
The withdrawal changes the specific enforcement mechanism previously established under MSMER-2023. However, medical institutions remain subject to the NMC Act, other applicable regulations and relevant legal requirements.
The removal of the prescribed penalty framework has also raised questions about how compliance with medical education standards will be monitored and enforced going forward. The precise implications will depend on the applicable laws, other regulations and any subsequent directions issued by the commission.
For medical colleges, the immediate priority remains compliance with existing statutory requirements, accurate reporting and the submission of mandatory disclosure documents. Students and prospective applicants should continue to check official NMC announcements for further regulatory updates.
